9.1 Acceptance and Consent. By providing your mobile telephone number to Champion Health and opting in to our text messaging program (the “SMS Program”), you expressly consent to receive recurring SMS/MMS messages from Champion Health, including messages sent using an automatic telephone dialing system or pre-set automated technology, at the mobile number you provided. You agree to these SMS / Text Messaging Terms (the “SMS Terms”), which form part of and are incorporated into these Terms and Conditions of Use. Consent to receive SMS messages is not a condition of purchasing any goods or services from Champion Health.
9.2 How You Opt In. You may opt in to the SMS Program by (a) submitting a form on champplan.com that includes an SMS consent checkbox or disclosure, (b) providing your mobile number and consent during employer-sponsored benefits enrollment, (c) opting in within the Champion Health mobile or web application during account setup, or (d) providing verbal consent to a Champion Health representative during a phone call, which we will document.
9.3 Messages You May Receive. The SMS Program is used to send (i) account and enrollment notifications (for example: welcome and verification messages, account or coverage status updates, identity confirmation, and password or security alerts) and (ii) customer support communications (including two-way conversational messages between you and our support team in response to a question, request, or open ticket).
9.4 Message Frequency. Message frequency varies based on your account activity and your interactions with our support team. You should generally expect up to approximately ten (10) messages per month, though actual volume may be higher or lower depending on activity.
9.5 Message and Data Rates. Message and data rates may apply. Charges are billed by and payable to your mobile service provider. You are solely responsible for any such charges. Please consult your mobile carrier’s pricing plan to determine the charges for sending and receiving text messages. Champion Health is not responsible for any charges incurred by you in connection with SMS messages.
9.6 Opting Out (STOP). You may cancel the SMS Program at any time by replying STOP to any message you receive from us. After you send STOP, we will send you a confirmation message and will not send you any additional messages from that program unless you opt in again. To rejoin, sign up as you did the first time.

9.8 Carriers; No Liability for Undelivered Messages. Carriers (including, but not limited to, AT&T, T-Mobile, Verizon, Sprint, Boost, U.S. Cellular, MetroPCS, and Cricket) are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission from your wireless service provider/network operator and is outside Champion Health’s control. You agree that neither Champion Health nor the participating carriers shall be liable for any delays in the receipt of, or failure to deliver, any SMS messages, as delivery is subject to effective transmission from your network operator and the technical capabilities of your device.
9.9 Eligibility; Your Representations. You represent and warrant that (a) you are at least 18 years of age; (b) you are the subscriber of, or are authorized to provide consent for, the mobile number you submit; (c) you will notify Champion Health if you change or relinquish that mobile number; and (d) your use of the SMS Program will comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA) and all applicable state laws and carrier rules. The SMS Program is available only to mobile numbers issued by participating U.S. wireless carriers.
9.10 No Sharing of Mobile Information for Marketing. Mobile phone numbers and SMS opt-in / consent data are not shared with or sold to third parties or affiliates for marketing or promotional purposes. Information collected as part of the SMS Program is used solely by Champion Health and the service providers we engage to deliver, secure, and support the SMS Program, who are contractually bound to use such information only to provide services to us.
9.11 Privacy. Information you provide in connection with the SMS Program is handled in accordance with our Privacy Policy.
9.12 Indemnification. You agree to indemnify, defend, and hold harmless Champion Health and its affiliates, officers, employees, agents, and service providers (including our SMS messaging provider) from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your breach of these SMS Terms, (b) your provision of a mobile number that you are not authorized to enroll, or (c) your violation of any applicable law or regulation in connection with the SMS Program.
9.13 Modification or Termination of the SMS Program. Champion Health may modify, suspend, or terminate the SMS Program (in whole or in part) at any time without prior notice. We may also remove any mobile number from the SMS Program at our discretion.
